FCC Chairman Pai Vows to Remove ‘Unnecessary or Counterproductive Regulations.’  At his first press briefing as Federal Communications Commission Chairman, Ajit Pai told reporters that the Commission’s main goal is to “remove unnecessary or counterproductive regulations from the books.”  These comments came after the Commission voted 3-0 to eliminate two requirements: (1) that commercial broadcast stations retain copies of letters and emails from the public; and (2) that cable operators maintain for public inspection the designation and location of a cable system’s principal headend.  Pai says, “These measures follow directly from Commissioner O’Rielly’s diligent work to identify unnecessary paperwork burdens.  In all, this action reduces regulatory burdens on commercial broadcasters and cable operators without adversely affecting the public interest.”  It remains to be seen if a Pai-led Commission will move to end the broadcast-newspaper cross-ownership ban in the near future.  Remember that Pai issued strong comments against keeping the ban after it was retained in the latest Quadrennial Review under former Chairman Tom Wheeler.  Pai also did not comment to reporters about his plans to move to overturn the net neutrality regulations passed during the Obama Administration.

TRN Suit Against Cumulus’ Westwood One and Others Partially Dismissed.  Oregon federal Judge Ann L. Aiken ruled yesterday (11/14) in agreement with a September recommendation by an Oregon magistrate judge to dismiss the antitrust suit filed by Talk Radio Network Enterprises LLC against Cumulus Media and other trn-logodefendants.  As regular TALKERS readers are probably aware, TRNE filed suit against Cumulus’ Westwood One, Compass Media Networks, LLC; Compass Media Marketing; WYD Management LLC; WYM Management LLC; Lewis Dickey; and Charles Steinhauer in 2012, and amended in 2013, alleging antitrust and unfair competition violations – that the defendants had conspired to and effectively did create a monopoly in the national radio ad sales sector.  What portions of that suit that weren’t dismissed were settled in 2014.  But, TRNE filed a very similar suit again in April of this year claiming that the illegal practices were ongoing by the defendants and that TRNE had suffered new injury.  Yesterday, U.S. District Judge Ann L. Aiken dismissed seven of the allegations with prejudice and the other seven without prejudice and granted the plaintiff the leave to replead (within 30 days).  The overriding reason for dismissal cited by Judge Aiken was that, “While Plaintiffs are correct that new antitrust violations may be alleged after dates covering a prior judgment, Plaintiffs have failed to show new antitrust conduct, thus necessitating dismissal of their claims.”

It is her last name – “McCain” – that makes the striking daughter of Arizona Senator and 2008 GOP presidential nominee John McCain particularly intriguing, while simultaneously putting her under more scrutiny than the typical media personality.
