limbaughrushDCCC Attorney Responds to Rush Limbaugh’s Demand for Apology.  Though the full text of the letter from an attorney for the Democratic Congressional Campaign Committee has not been released (or leaked!) yet, it’s clear from DCCC spokesperson Emily Bittner’s statement to the Washington Post’s Erik Wemple saying, “Our attorney sent a response letter noting that Limbaugh’s claims are absurd.”  If you remember, Limbaugh – who rarely responds to critics in this way, unless it’s fodder for show content – through attorney Patricia Glaser demanded an apology and a retraction for what she termed civilly actionable defamation for using part of Limbaugh’s discussion of campus sexual assault out of context to bring in donations to the committee.  Whether Limbaugh’s camp takes any further action remains to be seen.  TALKERS legal editor Steven J.J. Weisman commented recently about what Limbaugh’s lawyers would need to do in order to prevail in court in a defamation case.  He said, “Specifically, as a public figure, in order to be successful in a defamation action, Limbaugh would have to prove that the DCCC acted with malice – that is that they knew what they were saying was a lie or that they acted with a reckless disregard for its truth. Even more problematic for Limbaugh would be that he would have to prove that he was harmed by the comments. In order to be successful in his lawsuit he would have to show that he lost sponsors and/or listeners.”

dunnkentBeasley Begins to Fill Management Roles in CBS Markets.  The transfers of the following Beasley Broadcast Group managers to the soon-to-be-acquired CBS RADIO properties in Tampa will be effectivegentrytee upon the closing of the assets exchange agreement between the two companies.  First, Kent Dunn will leave Beasley’s Augusta, Georgia cluster to serve as the vice president and market manager for the new Tampa-St. Petersburg station group.  At the same time, Tee Gentry becomes operations manager for the five-station cluster that includes: sports talk duo WHFS-AM and WHFS-FM, hip hop WLLD, country WQYK, classic hits WRBQ, and Spanish WYUU-FM .  Dunn has been VP and market manager in Augusta while Gentry’s been serving as operations manager in Augusta.

okelleychrisO’Kelley Moves Up to OM a Beasley Augusta.  With the above-mentioned promotion of Tee Gentry from the Augusta, Georgia station group to Beasley’s future Tampa cluster, Chris O’Kelley is upped to OM from his current music director and APD post for country WKXC.  The Augusta station group also includes: news/talk WGAC, “580 AM and 95.1 FM News Talk,” CHR WHHD, “HD 98.3, WDRR, adult hits “93.9 BOB FM” WDRR-FM; rock WCHZ-AM and W238AU, “95 Rock,” WGUS-FM “The Southern Gospel Station at 102.7 FM and 93.1 FM,” and news/talk WRDW.  He’ll report to new VP and market manager Mark Haddon.

ppmunitRound Two of November PPM Data Released.  The second of four rounds of November 2014 PPM data from Nielsen Audio has been released for 12 markets including: Washington, Boston, Detroit, Miami, Seattle, Phoenix, Minneapolis, San Diego, Tampa, Denver, Baltimore, and St. Louis.  The survey period was October 9 through November 5.  TALKERS magazine’s sister publication RadioInfo has all of the numbers from subscribing stations here.  In addition, managing editor Mike Kinosian presents his “Ten Takeaways” from this batch of ratings on the main page at RadioInfo.com here.

sternbillboardHoward Stern Turns Over SiriusXM Channel to Graham Nash.  This afternoon at 3:00 pm ET (11/26), Howard Stern will break the format of his SiriusXM channel “Howard 101” to present a special show, “Howard Stern Presents: Graham Nash.”  Nash will be playing music from the live boxed set, CSNY 1974, and will “share personal stories and memories about the group’s historic 1974 summer tour.  The special will also include an exclusive in-studio acoustic set by Nash, including a performance of ‘Teach Your Children,’ and a new song written in tribute to The Band’s late drummer, Levon Helm.”  The program will be re-broadcast over the course of the holiday weekend.

Grand Jury Decision/Ferguson Rioting, Executive Amnesty Order, Obama Ozone Emissions Plan, 2016 Presidential Prospects, and Iran Nukes Negotiations Among Top News/Talk Stories Yesterday (11/25).  The protesting and rioting in Ferguson and across the country after the grand jury’s decision not to charge officer Darren Wilson in Michael Brown’s death; controversy over President Obama’s executive order for amnesty for illegal aliens; the new proposal from the Obama Administration for cutting ozone emissions; the potential candidates for president in 2016 and the nuclear negotiations with Iran were some of the most-talked-about stories on news/talk radio yesterday, according to ongoing research from TALKERS.

podcastone logoOwnership of Content is Not an Issue Just for Songwriters and Musicians.  The modern day mantra chanted by many consultants, programmers and air talent is that your content needs to be “everywhere” in the modern media world.  If this is indeed the best means of getting your programming the widest distribution to listeners, it doesn’t mean it’s okay to violate copyright laws and that’s the beef Podcast One chairman and CEO Norm Pattiz has with aggregator Stitcher.  A press statement by Pattiz and Podcast One announces the company is issuing a demand that the Deezer-owned aggregator “cease distribution of programming PodcastOne produces or has the exclusive sales rights to.”  Pattiz says that his company has tried to settle the issue amicably but that Stitcher continues to “sell and distributestitcherlogo programming without the proper rights, consent and compensation PodcastOne and its talent are due.”  Pattiz states, “In some cases, Stitcher has absolutely no rights to carry our programs, and in others, no rights to sell or monetize our exclusively represented content in any way.  This has been an ongoing problem, and enough is enough.  You can’t just steal content without permission.  Podcasting is breaking through big time, not only with consumers but with advertisers as well.  I see new players coming into the market, all touting technology that will allow them to grab podcasts for their subscribers.  Let this be a message: Make sure you have secured the rights from content suppliers before you distribute programing you don’t have the rights to.”  The Podcast One release reports that affected PodcastOne distributed and exclusively sold programs include: Adam Carolla, Clark Howard, Dan Patrick, Carcast, The Dr. Drew Podcast, Rich Eisen, Yahoo! pritchardjpJ.P. Pritchard Joins KNTH, Houston’s Sam Malone Show.  Joining the Sam Malone show on Salem Communications’ news/talk KNTH, Houston is market radio news pro J.P. Pritchard.  Malone tells TALKERS magazine that “the Dean of Morning Radio News,” is now part of his 7:00 am to 10:00 am daily show after exiting Radio One’s KROI after the station flipped formats from all-news to urban-rhythmic oldies.  Pritchard was also a longtime morning news anchor at crosstown KTRH during his career.  Check out the video the station made to announce his arrival here.

cookehollandCooke: Will You Be Ready When On-Demand Content Is Rated?  Radio consultant Holland Cooke notes that Nielsen recently announced it is preparing to rate on-demand video content and he questions whether radio will be ready when rating on-demand audio content begins.  What does he mean by “ready?”  He writes, “Most stations do on-demand all wrong, typically archiving on-air shows, deeper within the station website than many listeners will bother clicking.  Too often, those who do get there find whole hours labeled only by date and time.”  The most popular on-demand audio content is easy to find and made to fit the way consumers like to access it.  Read what Cooke has to say about making your on-demand programming easy-to-use, popular and salable here.

Odds & Sods.  The Boston Herald’s Gayle Fee writes in a recent column that Entercom Boston would like to get out of its expensive deal (or at the very least re-negotiate it) with the MLB’s Red Sox because the $17 million dollars per year rights fees are a big drain on revenue.  Games are heard on flagship WEEI-FM, Boston.  Market manager Phil Zachary tells the paper it’s not true that the station wants out.  Read the column here…..Doug Stephan — known for working holidays — will be hosting his “Good Day” morning program live on Thanksgiving.  In honor of the day, Stephan will be giving out free turkeys on the program.

allmanjamieKFTK-FM, St. Louis’ Jamie Allman to Debut TV News Show.  With the start of the New Year, KFTK-FM, St. Louis morning drive personality Jamie Allman will launch a television show to air on Sinclair Broadcast Group’s KDNL-TV, St. Louis “ABC 30.”  Allman and KDNL-TV are calling the new show a “non-traditional newscast” that will “be an informative, debate-driven format focusing on the topics of the day with guest commentators and a wide social media presence.  ‘The Allman Report’ will join together the power of radio and TV behind Jamie’s multiple Missouri Radio Broadcasting Awards and 15 Emmy Awards for his TV reporting.”  Jeff Allen programs Emmis news/talker KFTK-FM and he comments, “We are excited about the launch of ‘The Allman Report.’  Jamie has dominated St. Louis morning radio for years now and to extend that to TV every weeknight makes perfect sense.  ‘The Allman Report’ is going to be very different than what is currently available locally at 5:00 pm and 10:00 pm and Jamie will no doubt have the same impact on local TV that he has had on local radio.”  KDNL general manager Tom Tipton adds, “ABC St. Louis will provide its viewers a more thorough look at the stories that impact St. Louis through in-depth viewpoints from an array of newsmakers on a local, national and international scale.  No other news in St. Louis will provide the viewing public in our area this multi-platform reporting and commentary that is lacking in local news coverage.”

flight957 logoKGMZ, San Francisco Changes Morning Shows.  Off the morning drive show at Entercom’s sports talker KGMZ, San Francisco “95.7 The Game” is Chris Townsend and in are Chad Doing, Joe Fortenbaugh and former All-Pro NFL fullback Lorenzo Neal who make up the new “Flight 957” morning drive program.  Townsend will move to evenings on the station working with Zakariah on the 7:00 pm to 11:00 pm shift.  Doing comes to “95.7 The Game” from his most recent post at Alpha Media’s KXTG-AM, Portland “750 The Game” where he hosted the afternoon show.  Program director Jason Barrett comments, “We are changing the sound of Bay Area sports radio with the launch of this exciting new morning show.  Expect “Flight 957” with Chad, Joe & Lo to deliver a fresh, irreverent, and energetic spin on sports talk.  The new show is the latest example of our commitment to bringing The Game’s growing audience the best possible listening experience.”

Why do Kinder Eggs pull high view counts?  The answer reveals a profound difference between online video platforms and TV or passive video platforms.
