Cumulus v Johnny and Blondie Gets Underway in Michigan. Another non-compete case involving Cumulus Media is in the courtroom, this time in Michigan. Cumulus is suing former WHNN, Saginaw, Michigan morning personalities Johnny Burke and Bonnie Belger-Holzhei, a.k.a. Blondie, alleging they violated the non-compete and non-solicitation clauses in their contracts after being fired by the station earlier this year. As reported in MLive.com, this comes after the pair sued Cumulus for age discrimination. Cumulus is asking the court to prevent the duo from continuing to host the internet show they launched shortly after leaving the station. Interestingly, Cumulus is not after Burke for the non-compete violation since it would then have to pay six months of his $125,000 salary but is pursuing the non-compete matter with Belger-Holzhei as her salary was just $31,200. What Cumulus really appears to want is the court to find that they have been going after Cumulus clients to sponsor their internet show and force them to stop. Read the MLive story here.

Top Management Changes at CBS RADIO Chicago; Tim Pohlman to Lead Cluster as Zimmerman and Day Exit. Today, CBS RADIO COO Scott Herman
announced that Tim Pohlman is assuming the SVP and market manager position at the company’s Chicago cluster. This news comes a day after the staff was notified that Rod Zimmerman was let go as was VP and director of sales Mark Day. Pohlman has served with CBS in the same capacity at its Phoenix station group for the past six years. The initial press release from CBS did not mention Day’s exit
but the company later stated that it does not have a replacement for him yet. Chicago media writer Robert Feder reports that the changes are the result of underwhelming fiscal performances by the stations in the group. The 63-year-old Zimmerman had been with CBS RADIO since 1978. He ascended to the market manager position in 2003. CBS RADIO operates all-news WBBM-AM/WCFS-FM, sports talk WSCR, CHR WBBM-FM “B96,” country WUSN “US 99.5,” triple A WXRT, and classic hits WJMK. CBS says news of Pohlman’s replacement in Phoenix will come at a later date. Read Feder’s account here.
Emmis’ Fiscal Q3 Radio Revenue Down 5.1%. In announcing its fiscal third quarter figures, Emmis reports that its radio net revenue for the period was down 5.2% compared to local radio market revenue which rose 0.2%. The company says the battle in Los Angeles between its hip hop KPWR and iHeartMedia’s recently launched competitor KRRL has
affected revenue there and was “substantially all of our radio division’s shortfall against its markets.” The Indianapolis, St. Louis, and Austin clusters all beat their markets for the quarter. Emmis CEO Jeff Smulyan states, “Radio industry growth has been disappointing in 2015. Our markets are down 2.4% through the first eleven months of 2015. This general decline, coupled with the competitive situation in Los Angeles, led us to take a series of steps yesterday, including staff reductions and pay cuts for senior executives, to restructure our expenses to better align them with the current operating environment. We remain confident that we have the best team in media and the solution, in NextRadio, to return the radio industry to growth. Our ratings are quite strong in most of our markets, and our investments in content, sales hiring and training, and NextRadio and Digonex will begin to yield stronger results in 2016.”

FAIR Announces 2014 ‘Hold Their Feet to the Fire’ DC Radio Event. The 8th annual “Hold Their Feet to the Fire” radio row from Washington, DC will take place on April 9 and 10. The Federation for American Immigration Reform (FAIR) is organizing the broadcast event in which talk hosts from across the country will broadcast live for two days from Capitol Hill debating immigration reform while interviewing members of Congress, law enforcement officials, experts, activists and citizens who live along the border. FAIR reports, “This electronic town hall has grown each year due to mounting public concerns about illegal
immigration and because of talk radio’s expanding influence on the public policy process. With legislation expected in spring in the House, this year’s event is expected to be the largest yet with 60 or more hosts attending.” FAIR communications director Bob Dane adds, “We gather each year with a shared goal: To secure our borders and fight for principled immigration reform that puts American interests first. As usual, the wants and needs of Americans will be dismissed unless talk radio once again speaks on their behalf. Hoping that no one will notice, House Speaker John Boehner is planning to introduce the massive Senate amnesty bill in bits and pieces and massively increase foreign guest workers with no regard for unemployed Americans. Moreover, President Obama will continue abusing his executive power to grant backdoor amnesty. Both must be stopped.” This year’s event is taking place at the Phoenix Park Hotel on Capitol Hill in Washington. Reservations are required and hosts/producers should call now. There is no cost to attend and all technical engineering and ISDN lines are provided by Silver Lake Audio of New York, the official engineering firm for “Hold Their Feet to the Fire.” Congressional guests, activists, high-profile media personalities, and immigration experts will be in attendance and available throughout the event for wall-to-wall interviews.

Public Comment Period Opens on Nielsen’s LinkMeter Sale to comScore. When the deal for Nielsen to acquire radio ratings giant Arbitron was scrutinized by the Federal Trade Commission, one of the stipulations was that Nielsen would have to preserve the development of the LinkMeter technology being developed by Arbitron in conjunction with comScore and ESPN. That technology seeks to measure use across multiple media such as radio, TV and internet. With Nielsen developing its own service to accomplish the same goal, the FTC was concerned about the acquisition leaving just Nielsen developing cross-media measurement. It was expected that Nielsen would arrange to sell the LinkMeter to comScore and that’s what’s happened. The FTC states that the proposed order requires Nielsen to sell and license, for at least eight years, certain assets related to Arbitron’s cross-platform audience measurement services to an FTC-approved buyer. Accordingly, in its petition Nielsen is seeking FTC approval to divest the LinkMeter assets, license certain assets and capabilities, and provide equipment and services, to comScore. The petition details why Nielsen believes that comScore would be an appropriate party to acquire these assets. Public comments may be submitted to the FTC through February 24.

Meet Michael Berry
LOS ANGELES — Granted, it doesn’t quite convey the magnitude of Howard Stern’s “King of All Media” bravado, but “Czar of Talk Radio” is the tongue-in-cheek manner Michael Berry refers to himself. “If President Obama can name a czar for everything, then I’m the ‘Czar of Talk Radio,'” Berry reasons.
The moniker took off when he started it four years ago and Berry has capitalized on it. “Other talk hosts say they wish they branded it before I did.”
IRS Scandal: Time for Talk Show Hosts
to Come Forward
By Phil Valentine
Cumulus Media
Talk Show Host
NASHVILLE — The revelation on Friday (5/10) that the IRS was targeting conservative groups came as a shock to much of America, especially those on the right side of the aisle. Once the story broadened on Monday to include more groups and more abuse it became apparent that there’s something big going on here. For me, it was all simply a confirmation of something I’ve been experiencing for some time. In fact, I’ve been chronicling the experience on my radio show.
A couple of years ago I began getting inquiries from the IRS. They wanted me to explain certain items I’d taken as deductions. I had the same experience back in the mid-‘90s when I first moved to Philadelphia. I’m sure this isn’t the technical term for it but for lack of a better label I was “mail-audited” three times in 18 months. This was during the Clinton administration and I figured when I landed in Philadelphia to do talk radio I also landed on the administration’s radar. Again, it was petty stuff like making me dig up receipts from prior tax years and fill out all sorts of annoying forms. Once I satisfied the requests for one year another inquiry for another year would begin almost immediately.

LOS ANGELES — Master marketer Vince McMahon continues to build a vast “Sports Entertainment” empire largely owing to his uncanny knack of giving the “universe” of WWE fans the product they crave, a philosophy congruous with that of Massachusetts-born entrepreneur Marshall Field, who stressed that his Chicago-based department stores should, “Give the lady what she wants.”
Those taking heed of Messrs. McMahon and Field will – as Paul Simon & Art Garfunkel intoned in 1970 – “Keep the Customer Satisfied” (the “B” side of “Bridge over Troubled Water”).
Not only is the same applicable to an intensely entertaining and astute talk radio personality, it is his program’s cornerstone mantra.
