weismanstevenPayola: What Every Broadcaster Should Know.  TALKERS magazine legal editor Steven J.J. Weisman writes in a piece published today (2/19) that the Payola laws are something all broadcasters should be aware of, regardless of format.  While the Payola “scandal” of the late 1950s causes many people to associate Payola with playing records for consideration, any content that’s paid for must be identified.  Weisman writes, “The [Federal Communications] Commission has noted that the Sponsorship Identification Laws are ‘grounded in the principle that listeners and viewers are entitled to know who seeks to persuade them.’”  Read Weisman’s entire piece here.

mcmahonbillMcMahon: Listen to Your Creative Voice.  Talk radio consultant Bill McMahon says that all of us are born creative.  “From a very young age we all have a quiet little voice in our head that comes from somewhere deep inside.  It whispers unique and amazing thoughts and ideas to us.  In the beginning, we all hear these ideas, get excited, and do something about them. Unfortunately, the bigger and more unusual the ideas, the more resistance we encounter when we try to bring them to life.  Eventually, most of us stop listening to that quiet little voice, dismiss its thoughts and ideas, and just try to fit in because it’s too damn hard to do otherwise,” he writes.  McMahon believes that the successful content creators are the ones who still, not only listen to that creative voice, but act on some of the ideas it provides us.  Read more about his thoughts on creativity here.

goffjasonGoff Replaces Mannelly at ‘The Score’ in Chicago.  The new co-host at CBS RADIO’s sports talk WSCR, Chicago “670 The Score” is Jason Goff.  He’ll be working alongside Matt Spiegel on the 9:00 am to 1:00 pm show.  The former producer and reporter has also hosted at the company’s Atlanta sports talker wscr logoWZGC “92.9 The Game” and SiriusXM.  “The Score” operations manager Mitch Rosen says, “I’m excited to have Jason back on our team.  I believe the combination of Matt Spiegel and Jason Goff will be a great winning combination that the Chicagoland audience will love.  The show will be interactive through all of our digital platforms.”  Former Chicago Bears long snapper Patrick Mannelly worked as co-host with Spiegel after Dan McNeil exited the same position last June after a long career with WSCR.  McNeil recently joined crosstown classic rock WDRV “The Drive” as AM drive co-host.

businessrockstars radio‘Business Rockstars’ to Be Heard on 11-station Mississippi ‘SuperTalk’ Network.  The “Business Rockstars” radio show adds to its affiliate roster by being carried across the 11-station TeleSouth Communications-owned SuperTalk Mississippi network.  Saying that this new deal pushes its affiliate tally “well past the 100 U.S. radio mark,” Business Rockstars CEO Steve Lehman comments, “Radio is an important part of our multi-media and social platform.  We couldn’t be more excited to add SuperTalk.FM to our rapidly growing list of affiliate stations…Business Rockstars is an entrepreneurial business show that brings together some of the world’s biggest and most accomplished CEOs as well as successful small business owners and entrepreneurs.  We look forward to adding new listeners in Mississippi that will benefit from Business Rockstars content.”  TeleSouth president and COO Kim Dillon states, “‘Business Rockstars’ is a great show and we’re certain the listeners across the SuperTalk Mississippi network will benefit from their insightful commentary and tips.  Entrepreneurship is alive and well in our state.  We look forward to inspiring current and future business owners throughout our long and prosperous relationship with the Rockstars team.”

sternhowardDigital Start-Up Whalerock Gets Attention After Inking Howard Stern to Deal.  From a piece in The New York Times comes news that Howard Stern has agreed to a deal with Whalerock to have the latter create a “personal network” to handle digital distribution of his content.  This is a separate deal from Stern’s SiriusXM contract and Whalerock owner Lloyd Braun tells the paper he is conscious of the existing contracts of his talent and doesn’t want to get into legal disputes.  It appears Whalerock will differ from other digital platforms in that it is targeting established celebrities and designing “personal networks” for each as opposed to providing “space” for content creators on a larger, menu-type platform.  As usual, terms of all deals are confidential but other celebs reported to be on board are the Kardashian sisters and rapper Tyler, the Creator.  In the piece, Braun says celebs are eager to work with Whalerock because it cuts out the “middleman” of traditional media platforms.  The TimesBrooks Barnes astutely points out that there is still a middleman in these deals – that middleman is Whalerock.  Still, it certainly appears that Whalerock’s work handling the aspects of distribution, sales, etc., that celebs don’t want to get involved in themselves is what they get in return for some consideration.  Read the entire Times piece here.

ppmunit altRound Two of January PPM Data Released.  The second of four rounds of January 2015 PPM data from Nielsen Audio has been released for 12 markets including: Washington, Boston, Detroit, Miami, Seattle, Phoenix, Minneapolis, San Diego, Tampa, Denver, Baltimore, and St. Louis.  The survey period was January 1-28.  TALKERS magazine’s sister publication RadioInfo has all of the numbers from subscribing stations here.  In addition, managing editor Mike Kinosian presents his “Ten Takeaways” from this batch of ratings on the main page at RadioInfo.com here.

weismanBOSTON — For many years it has been a violation of both federal law and FCC regulations for radio stations to neglect to inform the listening audience when someone has provided payment, services or something else of value in return for getting something on the airwaves.  This practice of paying for play has come to be known as “Payola” although the term does not specifically appear in any of the laws or regulations.

Payola has a rich and colorful history that includes both Congressional hearings and comments in 1960 by President Dwight Eisenhower who referred to Payola as an issue of public morality and called for laws to make Payola a crime.

redskins logoWWXX License Renewal Objection Draws Response. The FCC is considering whether it should rule if the team name of the NFL‘s Washington franchise (“Redskins”) is indecent.  One of that team’s three radio flagships – Red Zebra Broadcasting-owned WWXX – has filed its answer to objections regarding the renewal of its broadcast license.  WWXT (92.7) and WWXX (94.3) repeat the signal of primary flagship WTEM “ESPN 980.”  Red Zebra states that its response “makes clear that under the Communications Act and the First Amendment, the FCC should not be in the business of censoring the content of radio stations.  Any debate about the team’s name and its meaning should be held in the free marketplace of ideas, not in the halls of the FCC or any other governmental agency.”  Red Zebra counsel Andrew McBride of Wiley Rein LLP comments, redzebra“We hope the FCC will swiftly reject this transparent attempt to use the license renewal process to intimidate broadcasters across the country with the baseless threat that accurately reporting on the Washington football franchise by using the team’s full name violates any law or FCC regulation.”  Many consider the name of the DC franchise a slur to Native Americans and they have called on team owner – and Red Zebra primary investor – Dan Snyder to change it.  President Barack Obama is among those fccasking the NFL to endorse a name alteration, as are at least one-half the members of the U.S. Senate.  In a preliminary 18-page formal petition to deny renewal of a station’s FCC broadcast license, petitioner John F. Banzhaf III, “a listener to station WWXX, respectfully requests on behalf of himself and others similarly situated, and who are like himself adversely affected or aggrieved, that the agency deny the renewal of this station’s license and any other requests.  It deliberately, repeatedly, and unnecessarily broadcasts the word ‘R*dskins’ during most of its broadcasting day, and especially in prime time where its well documented adverse impact on impressionable young Indian as well as non-Indian children is greatest.  Through its licensee and controlling owner Dan Snyder, also actively encourages or indeed forces many other broadcasters to likewise broadcast a derogatory racial and ethnic slur contrary to the public interest.”  Banzhaf is an American legal activist and a law professor at George Washington University Law School.  The Washington Post editorial board has stopped using the team’s name, and a panel of the U.S. Patent and Trademark Office canceled the team’s trademark registration four months ago.  Even so, Snyder vows to keep the name.  TALKERS legal editor Steve J.J. cookehollandCooke: Two Weekend Problems, Two Solutions.  In a piece written exclusively for TALKERS, radio consultant Holland Cooke addresses two weekend problems that face talk radio stations and offers a couple of solutions.  He says ask-the-expert shows – i.e. brokered programming from local attorneys, real estate agents, veterinarians, etc. – don’t have to sound bad!  Coach them so their broadcasts are well-executed and informative.  Plus, let these clients use your listen-on-demand capabilities to reach more potential customers and they will be more satisfied with the money they are spending on your station.  Read Cooke’s entire piece here.

barnesgabeHow Mobile Can Save Your Talk Radio Brand.  Digital media pro Gabe Barnes says, in a column exclusive to TALKERS, that he’s surprised by the number of radio execs who are put off by the reported amount of radio app usage that takes place outside of the station’s broadcast range.  They see primarily the streaming fees for a listener who’s outside the “market.”  The Mersoft Media director, business development says that’s not necessarily bad.  “Many of those listening out of the broadcast range are actually local residents or have some ties to that local community.  A local advertisement would be just as effective, provided the advertisement is compelling and targeted.”  But there are more advantages for getting fans of your programming to go “mobile” with it.  Read Barnes’ entire column here.

wtic logoWTIC, Hartford License Renewal on Enforcement Hold.  With the conviction of former Connecticut Governor John Rowland – until April of 2014 the afternoon drive personality on WTIC, Hartford – on campaign fraud charges in the rear view, CBS RADIO’srowlandjohn news/talk WTIC, Hartford is now waiting out an enforcement hold on his license renewal with the FCC.  In a story in the Hartford Courant, Edmund Mahony writes that the hold on the process is due to a “payola” complaint to the FCC related to Rowland’s actions promoting a Republican candidate in a primary race without disclosing – either to the radio audience or the FEC – that he was on that candidate’s payroll.  The FCC doesn’t comment on the specifics of these matters and CBS RADIO is simply confirming that the process is on hold but the company does not know why.  Rowland is set to be sentenced in January.  The station certainly took its share of criticism for hiring Rowland after his first conviction in 2004 on corruption charges related to activities while in the governor’s office.  Now, the station may be liable for a fine or reprimand, according to experts Mahony cites in his story.  Most experts agree a denial of the license renewal for WTIC is unlikely, to say the least.

espnradioESPN Radio to Air World Series. This marks the seventeenth straight year that ESPN Radio has exclusive radio rights to MLB‘s World Series.  ESPN “Sunday Night Baseball” lead play-by-play announcer Dan Shulman and analyst Aaron Boone will function in those capacities on the radio broadcasts for the best-of-seven series that commences tomorrow night (10/21) between the Kansas City Royals and San Francisco Giants.  Pre-game and post-game coverage will be handled by Jon Sciambi, analyst Chris Singleton, ESPN MLB insider Peter Pascarelli, and Marc Kestecher.  Meanwhile, for the tenth successive year, ESPN Deportes Radio will broadcast every game for a Spanish-speaking audience.  San Diego Padres Spanish-language announcer Eduardo Ortega will be joined by Renato Bermudez, Armando Talavera, and Jose Francisco Rivera.
